This Terms & Conditions covers all our sales. However, there are specific conditions covering online sales, where applicable.
Consumer Guarantees: All goods sold by Nerd Neighbour come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to a replacement or refund for a major failure. You are also entitled to have the goods replaced or repaired if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Repaired By Manufacturer: Goods presented for repair may be replaced by manufacturer-refurbished goods of the same type rather than being repaired. Manufacturer-refurbished parts may be used to repair the goods.
Prices and Order Acceptance: All prices shown on this website are in AUD, are subject to change without notice, and include 10% GST (Goods and Services Tax). Your order confirmation email will show the total including GST, and you will receive a final Tax Invoice once we have accepted your order and shipped it. Prices may change from time to time, and all our prices are in AUD and include Australian GST. Product prices are regularly updated when price changes are received from our suppliers. Please note that an order is an offer to purchase and does not constitute a binding contract until accepted by us. A binding contract only exists when we deliver your order.
Any automated confirmation of a successful order placement and/or receipt and/or our processing of a payment does not constitute acceptance of an order by us. If we decline your order after payment has been processed, we will contact you with details and refund the payment in full. Product descriptions are not warranted by Nerd Neighbour as correct, complete, current, or error-free.
We require payment for all transactions to be cleared before delivery. Ownership of any product purchased will only be transferred to you when payment is received and cleared in full. You may be charged a processing fee for transactions. We are not responsible for any delay associated with processing your payment caused by third parties or financial institutions.
If we do not have your order in stock, a third party may ship the order on our behalf. By placing an order, you consent to us sharing your details with this third party in accordance with all Australian laws.
Changes or cancellation requests may be made through our contact details on the website. A restocking fee may apply.
Shipping & Delivery Policy: We ship to all destinations in mainland Australia (including Tasmania) using a selection of couriers. Shipping costs are calculated at checkout and influenced by the size and weight of the product and your location. FREE shipping covers most metro areas, but some remote areas are exempted. Please refer to our shipping calculator for exact costs and free shipping status.
We aim to ship all accepted orders, where products are in stock, as soon as possible. Items will normally be dispatched within 1 business day after payment has been received in full. Once we dispatch your order, we will not be able to refund due to a change of mind.
Returns: You can handle returns by contacting us at [email protected] with valid proof of purchase. Most warranty claims are handled by the manufacturer, and you can contact them directly with warranty details.
Indemnification: You agree to indemnify and hold harmless Nerd Neighbour and all associated companies from any legal action under Australian and international laws pertaining to the use of this website and the purchase of products or services.
Limitation of Liability: Nerd Neighbour shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of this website or the purchase of any products or services.
No Warranty: Except as provided by law, Nerd Neighbour makes no representations or warranties of any kind, express or implied, regarding the products sold on this site.
Governing Law: These Terms & Conditions are governed by the laws of Australia. You agree to submit to the exclusive jurisdiction of the courts located in Australia for any disputes arising from these Terms.
Severability: If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable.
Dispute Resolution: In the event of a dispute, both parties agree to attempt to resolve the issue amicably through negotiation before pursuing any legal action.
Modification of Terms: Nerd Neighbour reserves the right to modify these Terms & Conditions at any time without prior notice. It is your responsibility to review these Terms periodically for updates.
Other Issues: Images on the Nerd Neighbour website are for illustration only. Actual products may appear different. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, agreeing to accept responsibility for all activities that occur under your account.
Nerd Neighbour reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in its sole discretion.
